1. Acceptance of Terms

These Terms and Conditions apply to your access to and use of the Fix Finder website, mobile application, platform, software, services, content, features, payment tools, communication tools, and any related services provided by Fix Finder Limited.

By registering, accessing, browsing, posting a job, accepting a job, making payment, receiving payment, or using the Platform in any way, you agree to be bound by these Terms.

If you use the Platform on behalf of a company, business, organisation, partnership, trust, or another person, you confirm that you are authorised to accept these Terms on their behalf.

If you do not agree with these Terms, you must not access or use the Platform.

2. About Fix Finder

Fix Finder is an online marketplace platform designed to connect people or businesses who need work completed with independent service providers, contractors, professionals, technicians, tradespeople, or other users who may offer such services.

Fix Finder may allow users to:

Customers may post Jobs through the Platform.

A Customer must ensure that each Job listing is accurate, lawful, clear, and complete.

A Job listing may include:

Customers must not post misleading, illegal, unsafe, discriminatory, offensive, or prohibited Jobs.

Fix Finder may remove or edit any Job listing at its discretion.

9. Quotes, Offers, and Acceptance

Service Providers may submit quotes, offers, estimates, or proposals for Jobs.

By submitting an offer, the Service Provider confirms that they:

A binding agreement between the Customer and Service Provider is formed when the Customer accepts an offer or booking through the Platform.

Fix Finder is not a party to that agreement unless expressly stated in writing.

10. Payment, Platform Fees, and Commission

Fix Finder may charge:

Fix Finder may change fees from time to time. Continued use of the Platform after a fee change means you accept the updated fees.

Payments may be processed using third-party payment providers such as Stripe, Windcave, PayPal, bank transfer, or other providers made available on the Platform.

Users agree to comply with the terms and policies of any third-party payment provider used.

11. Escrow or Held Payments

If Fix Finder offers an escrow, holding, pending payment, or payment release feature, the Customer may be required to pay the Job Price before the Job starts or before the Service Provider is confirmed.

Funds may be held until:

Fix Finder may release funds to a Service Provider if we reasonably believe the Job has been completed or substantially completed and the Customer is unfairly withholding payment.

Fix Finder may hold funds during a dispute or investigation.

12. Completion of Jobs

After completing a Job, the Service Provider may mark the Job as complete through the Platform.

The Customer must review the work promptly and either:

Service Providers must not mark a Job as complete if the work has not been completed or delivered.

13. Cancellations and Refunds

Cancellation and refund rights may depend on the stage of the Job, the type of service, the payment method, and whether work has already started.

Platform fees, payment processing fees, advertising fees, subscription fees, verification fees, and administration fees may be non-refundable unless required by law.

14. Consumer Guarantees

Nothing in these Terms limits any rights a consumer may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other applicable New Zealand consumer law.

Where a Customer is acquiring services for personal, domestic, or household use, certain legal guarantees may apply.

Where a business user acquires services for business purposes, the parties may agree, where legally permitted, that the Consumer Guarantees Act does not apply.

15. Service Provider Responsibilities

Service Providers must:

16. Customer Responsibilities

Customers are responsible for ensuring that the Job location is safe and suitable for the Service Provider to attend.

17. Prohibited Services and Conduct

Users must not use the Platform for:

Fix Finder may remove content, cancel Jobs, withhold payments, suspend accounts, report conduct to authorities, or take legal action where necessary.

18. Off-Platform Dealings

Users must not use Fix Finder to find or contact another user and then complete the transaction outside the Platform to avoid fees.

If a Customer and Service Provider connect through Fix Finder, Fix Finder may still be entitled to applicable fees, commission, or compensation if the parties complete the Job outside the Platform.

Fix Finder is not responsible for disputes, non-payment, damage, poor workmanship, safety issues, or loss arising from off-platform arrangements.

19. Reviews, Ratings, and Feedback

Users may be able to leave reviews, ratings, comments, or feedback.

Reviews must be honest, fair, and based on genuine experience.

Users must not:

Fix Finder is not responsible for user-generated reviews or ratings.

20. Verification, Badges, and Background Checks

Fix Finder may provide verification badges, trust badges, profile checks, qualification checks, identity checks, police checks, credit checks, or other verification features.

Verification does not guarantee that a user is reliable, safe, qualified, insured, honest, or suitable.

Users must make their own assessment before accepting or performing a Job.

Fix Finder may remove badges or verification status at any time.

21. Advertising and Promotions

Fix Finder may allow paid listings, sponsored results, banner advertisements, featured profiles, promotional placements, or other advertising features.

Paid advertising does not mean Fix Finder endorses or guarantees the advertiser, user, service, product, or outcome.

Advertisers are responsible for ensuring their advertisements are accurate, lawful, and not misleading.

22. User Content

You retain ownership of content you upload, but you grant Fix Finder a worldwide, royalty-free, non-exclusive licence to use, store, display, reproduce, modify, publish, and distribute your content for the purpose of operating, marketing, improving, and promoting the Platform.

23. Intellectual Property

All intellectual property in the Platform, including software, branding, logos, graphics, layouts, designs, features, databases, text, icons, workflows, and technology, belongs to Fix Finder or its licensors.

You must not copy, reproduce, reverse engineer, modify, sell, license, exploit, or create derivative works from the Platform without written permission.

You may only use the Platform as allowed by these Terms.

24. Privacy

Fix Finder collects, stores, uses, and shares personal information in accordance with its Privacy Policy.

Users should read the Privacy Policy before using the Platform.

Fix Finder is not responsible for third-party services, outages, errors, fees, data handling, or terms.

Your use of third-party services may be subject to separate terms and privacy policies.

27. Platform Availability

Fix Finder aims to keep the Platform available but does not guarantee uninterrupted, secure, or error-free access.

The Platform may be unavailable due to maintenance, upgrades, faults, cyber incidents, third-party outages, payment provider issues, internet failures, or events outside our control.

Fix Finder is not liable for losses caused by Platform downtime or delays, except where liability cannot be excluded by law.

28. Safety Disclaimer

Users are responsible for their own safety when meeting, attending job sites, entering premises, or performing work.

Customers and Service Providers should take reasonable precautions, including:

29. Disputes Between Users

If a dispute arises between a Customer and Service Provider, the users should first try to resolve the matter directly and professionally.

Fix Finder may, at its discretion, assist with dispute resolution, request evidence, review messages, hold payments, release payments, issue refunds, suspend accounts, or make a platform decision.

Fix Finder is not obligated to act as mediator, arbitrator, legal adviser, debt collector, or enforcement agency.

If a dispute cannot be resolved through the Platform, users may seek independent legal advice or use the Disputes Tribunal, District Court, mediation, or another lawful dispute resolution process.

30. Suspension and Termination

Fix Finder may suspend, restrict, or terminate your account immediately if:

31. Limitation of Liability

Service Providers are responsible for their own tax, GST, ACC, insurance, employment, accounting, and business obligations.

Fix Finder does not provide tax, legal, financial, or accounting advice.

34. Force Majeure

Fix Finder is not liable for delay or failure caused by events beyond its reasonable control, including natural disasters, extreme weather, fire, flood, earthquake, pandemic, war, civil unrest, cyberattack, government action, power failure, internet outage, payment provider outage, or third-party system failure.

35. Governing Law

These Terms are governed by the laws of New Zealand.

The parties submit to the exclusive jurisdiction of the courts of New Zealand.

36. General Terms

If any part of these Terms is found to be invalid, illegal, or unenforceable, the remaining parts continue to apply.

Failure by Fix Finder to enforce a right does not mean we waive that right.

You may not assign your rights or obligations under these Terms without our written consent.

These Terms, together with the Privacy Policy and any additional policies published by Fix Finder, form the entire agreement between you and Fix Finder regarding use of the Platform.
